1. Acceptance of Terms

These Terms and Conditions (hereinafter "the Terms") govern the use of the MONO platform, operated by DEPLOYALO SA DE CV (hereinafter "the Company"), a company duly incorporated under the laws of Mexico.

By creating an account, accessing, or using MONO, you agree to be bound by these Terms in their entirety. If you do not agree with any provision herein, you must refrain from using the platform.

MONO reserves the right to modify these Terms at any time, providing users with at least 30 days' notice through the platform or by email. Continued use of the service after the modifications take effect shall constitute your acceptance of the updated Terms.

2. Service Description

MONO is an AI-powered personal assistant platform that operates through messaging services, including WhatsApp, Telegram, and Discord. The service enables users to interact with an AI agent capable of performing various tasks, including but not limited to:

• Internet information search
• Reminder and calendar management
• Invoice generation and management
• Expense tracking
• Price monitoring and deal alerts
• Secure document storage
• Group conversation summarization
• Other functionalities available through skills

Each user is provided with a dedicated private virtual server (VPS) with AES-256-GCM encryption and zero-knowledge architecture to ensure maximum data privacy.

3. Eligibility

To use MONO, you must be at least 13 years of age. If you are under 18 years of age, you represent that you have the consent of your parent or legal guardian to use the service.

By registering, you represent and warrant that the information you provide is truthful, complete, and up-to-date, and that you have the legal capacity to accept these Terms.

4. User Account and Responsibilities

You are responsible for maintaining the confidentiality of your access credentials, including your password and any API keys you configure on the platform.

• You are solely responsible for all activity that occurs under your account.
• You must immediately notify MONO of any unauthorized use of your account.
• API keys configured by the user (BYOK - Bring Your Own Key model) are the sole responsibility of the user, including any costs and usage limits associated with those keys.
• MONO shall not be liable for charges incurred on user AI provider accounts resulting from the use of their own API keys.

5. Pricing and Plans

MONO offers the following subscription plans:

Premium Skills

Additionally, MONO offers premium skills that can be activated for an additional monthly fee per skill. Basic skills (Memory, AI Browser, and Reminders) are included in both plans. Pricing for each premium skill is displayed in the platform's marketplace.

6. Payments and Billing

• All payments are processed through Stripe, a PCI DSS Level 1 certified payment platform.
• Prices are denominated in Mexican pesos (MXN) and include applicable taxes where required.
• Subscriptions automatically renew at the beginning of each monthly billing period.
• Charges are applied to the payment method registered in your Stripe account.
• In the event of a payment failure, MONO may suspend the service until payment is regularized.
• No refunds are issued for partial usage periods.

7. Cancellation

You may cancel your subscription at any time through the platform or by contacting legal@mono.chat.

• Cancellation takes effect at the end of the current billing period. You may continue using the service until that date.
• Upon cancellation taking effect, all your data will be permanently and irreversibly destroyed, including messages, files, settings, and assistant memory.
• Deletion is performed through cryptographic key destruction, rendering all encrypted data mathematically unrecoverable.
• Once data is destroyed, it cannot be recovered. Please ensure you export any information you wish to retain before cancellation.

8. Acceptable Use

By using MONO, you agree not to:

• Use the service for illegal, fraudulent, or infringing activities.
• Send spam, unsolicited bulk messages, or malicious content through the platform.
• Abuse AI services, including attempts to bypass safety filters or generate harmful content.
• Attempt to access accounts, servers, or data belonging to other users.
• Reverse-engineer, decompile, or attempt to extract the source code of the platform.
• Use the service in a manner that could damage, disable, or overburden MONO's infrastructure.
• Resell, sublicense, or share access to your account without authorization.
• Use the service to generate content that infringes on third-party intellectual property rights.

MONO reserves the right to suspend or terminate accounts that violate these usage policies, without prior notice and without obligation to refund.

9. User-Provided API Keys (BYOK)

If you opt for the BYOK plan, the following conditions apply:

• You are solely responsible for obtaining, configuring, and maintaining your API keys with AI providers.
• All costs incurred from AI usage through your API keys are your sole responsibility.
• MONO does not guarantee the availability, performance, or limits of third-party services accessed through your API keys.
• You must comply with the terms of service of each AI provider whose keys you use.
• MONO securely encrypts and stores your API keys, but you acknowledge that these keys are necessary for the operation of the service and will be used to make requests to AI providers on your behalf.

10. Intellectual Property

The MONO brand, logo, platform design, source code, system architecture, and all associated materials are the exclusive property of DEPLOYALO SA DE CV and are protected by Mexican and international intellectual property laws.

User-generated content on the platform remains the property of the user. MONO does not claim ownership rights over messages, files, or data that you store on the platform.

11. Limitation of Liability

To the maximum extent permitted by applicable Mexican law:

• MONO is provided "as is" and "as available," without warranties of any kind, whether express or implied.
• Responses generated by artificial intelligence are informational in nature and do not constitute professional advice of any kind (legal, medical, financial, tax, or otherwise).
• MONO shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from the use or inability to use the service.
• MONO's total cumulative liability to the user shall not exceed the amount paid by the user in the 12 months preceding the event giving rise to the claim.
• MONO shall not be liable for service interruptions caused by factors beyond its reasonable control, including AI provider failures, messaging platform connectivity issues, or force majeure events.

12. Service Availability

MONO uses its best efforts to maintain continuous service availability. However, no Service Level Agreement (SLA) is guaranteed.

The service may experience interruptions due to scheduled maintenance, platform updates, or unforeseen circumstances. MONO will notify users of scheduled maintenance with as much advance notice as possible.

13. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the United Mexican States (Mexico).

For the resolution of any dispute arising from these Terms, the parties expressly submit to the jurisdiction of the competent courts of Mexico City, waiving any other jurisdiction that may correspond to them by reason of their present or future domicile.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable by a competent court, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable, while preserving the parties' original intent.
